PRODUCT AVAILABILITY
Fairleys Shoe Store aims to provide accurate stock availability, however Fairleys Shoe Store Online Store cannot guarantee up to date stock numbers at all times. This only relates to online stock availability. Not all styles, colours and sizes may be available in our bricks and mortar stores.
VARIATION
Fairleys Shoe Store has the right at any time and without notice to amend, remove or vary the products, prices, services and any pages of its website. Pictures should be viewed as a guide only. Actual colours may vary.
TERMS OF SALE
All prices are listed in $AUD. By placing an online order with Fairleys Shoe Store for any of our products, you are offering to purchase the goods on and subject to our Terms and Conditions.
When placing an order, you acknowledge that all your details are true and accurate and that you are the authorised user of the credit or debit card used to place the order, and that there are sufficient funds to cover the cost.
CANCELLATION
Fairleys Shoe Store may cancel an order if the product is not available for any reason. Should this occur we will notify you by Email and will return any payment you have made.
We will refund the money received using the same method of payment used by you at the checkout to pay for the product.
If you wish to cancel your order, please notify us on 08 8391 1114. No cancellation fees will apply if this occurs before the order is dispatched. Once the order has been dispatched it cannot be cancelled, and instead the item must be returned using our returns system in new condition in order for a full refund to be given. Note, Fairleys Shoe Store bricks and mortar stores do not offer refunds unless an item is faulty.
DELIVERY
Dispatch times may vary depending on availability of stock. Fairleys Shoe Store Online Store make no guarantee or representations of exact dispatch and delivery times. We endeavour to dispatch items to Australia Post within (5) five business days. Items that are not in stock at time or purchase will be dispatched to Australia Post as soon as possible once they arrive in stock.
All items will be posted via Australia Post. Once dispatched to Australia Post delivery times will vary and are subject to Australia Post. Exact delivery times are dependent on forces outside of Fairleys Shoe Store Online Store control.
In situations where multiple items are purchased and the entire order is not in stock Fairleys Shoe Store Online Store will dispatch items separately.
Fairleys Shoe Store Online Store will contact you if there are any expected delays in dispatching your shoes from our store; however we will not be held liable for any loss, damage, costs, liabilities, changes or expenses arising from late delivery.
RETURNS POLICY
PROOF OF PURCHASE
All returned goods must be accompanied by a proof of purchase regardless of the reason of return.
REFUNDS
If, for any reason you are unhappy with your purchase, we will happily provide you with a refund. Simply post your unwanted goods to us at 23 Gawler Street Mt Barker SA 5251. Goods must be returned in their original condition, with original packaging and labels, within 14 business days from the date of dispatch together with a copy of proof of purchase. Please note that this refund policy is for ONLINE purchases only.
Returned items remain the responsibility of the customer and are returned at the customers expense unless the item is faulty, damaged or incorrectly supplied. Refunds are always processed using the original method of payment at the time of purchase. (PayPal or Credit Card) Please Note: A refund will not be processed if the goods returned do not comply with our Returns Policy.
FAULTY OR INCORRECT SUPPLY OF SHOES
If you intend to return a faulty or incorrectly supplied item, please notify us on (08) 8391 1114 or email us at fairleysshoes@bigpond.com for advice before returning the item. Only goods with manufacturing defects can be returned as faulty. All returned goods will be inspected for manufacturing faults. Damage caused by wear and tear may not be deemed as faulty. You will be notified by email and the goods will be returned to you at your own expense. Goods deemed as faulty, will be replaced/repaired subject to availability or otherwise we will issue a full refund to the value of the damaged item(s) and shipping costs credited by the method of payment at time of purchase.
CIRCUMSTANCES BEYOND OUR CONTROL
Fairleys Shoe Store shall not be liable to you for any breach, hindrance or delay in the performance of a contract attributable to any cause beyond our reasonable control.
INDEMNITY
You agree to indemnify, defend and hold harmless Fairleys Shoe Store , its directors, officers, employees, consultants, agents and affiliates from any and all third party claims, liability, damage and/or costs (including but not limited to legal fees) arising from your use of this website or your breach of these Terms and Conditions.

Fairleys Shoe Store reserves the right to amend these Terms and Conditions at any time and without informing you. All changes will be posted online and continued use of the site will be deemed acceptance of the new Terms and Conditions.
